Visual Artists

Included for visual artists are a basic collection of samples and models to consider for business purposes related to sales, consignment or licensing to protect the artist’s economic rights and copyrights with other best practice provisions. There is a PDF file of the Georgia consignment law with other Georgia art laws found under the Advocacy menu tab with pdf files of each. You will also find links to a list of visual art organizations, and other resources like the U.S. Copyright Office website for purposes of registering your art for protection. NOTE: This is a sample Artist-Gallery Letter Agreement for use in Georgia.  While it contains the Georgia statute’s mandated information of value of the work, minimum price for sale and time for payment, it may be beneficial for an individual artist to use a longer form agreement like the Model Art Consignment Agreement which has greater detail on important issues including duration of consignment, exhibition dates, transportation responsibilities, insurance, promotional activities and termination of the agreement.

NOTE: This is a Model Art Consignment Agreement. [The Artist will generally use the Consignment Agreement that their local gallery uses subject to close review, negotiation of the details and addition of special provisions.]  This model gallery agreement is used when the Artist needs a standard consignment agreement for consigning works to a gallery usually outside of the artist’s home state.  Artist’s copyright rights should be protected with the copyright notice on all of the works consigned.  The Artist should seriously consider registering any consigned works with the U.S. Copyright Office.

Limited Edition Agreement Download Ltd Edition Agreement PDF

NOTE: This is an example of a Contract to Create a Limited Edition of a work of art.  Importantly, it reserves the artist’s copyright and other reproduction rights.  Other significant provisions include artistic control, loss or damage to the edition, advances to the artist and non-assignability. This version would be applicable when a community arts agency and the artist want to create a limited edition of a work for sale as part of an exhibition by the artist at the arts agency venue.
